its still on there property and they have the right to tell you what you can do on there property
On their property they set the rules. Don’t like it? You have the right to quit.
It sounds unfair but I’m sure they ban *** and B.J.’s in your car on their property also. Try driving down the street at lunch and having a smoke instead.
From my interpretation (and I am certainly no lawyer), this does not seem to be illegal or infringe upon privacy. Companies have the right to establish smoking areas wherever they wish. Since your car is parked on their property, and most likely would come back smelling like cigarette smoke, it is not a far stretch for your employer to ban smoking in your vehicle.
Yes, I believe they can do that since it’s on their property. We smokers are second class citizens today, and it’s not going to get any better. They just keep pushing, and before long I’m sure they’ll tell you that you can’t enter their building if you smell like smoke. They will push until we try to stop them as a group, but unfortunately, we are out numbered now. If it were me, I would have told whoever interviewed me that I was a smoker and ask about the rules at that time. I would not have accepted the job. If these rules were put in place after you started working there, I would probably quit smoking on the job, or quit the job. Too bad they don’t value you as an employee, or they would have a smoking area for the smokers because most businesses do have smokers.
