They can try to make enough sales from tobacco related products to fall into the expemt places. Here in Houston, if a certain percentages of sales are tobacco related (cigs, cigars), then they are expemt from the ban.

I live in Washington State and I smoke. I don't have an issue going outside to smoke. I am one of those rare smokers that is actually considerate of non-smokers. I NEVER smoke inside my own home or anyone elses. I ALWAYS ask the people around me if they mind if I smoke when I light up outside.

Just because I don't have an issue with pre-mature death doesn't mean I don't have an issue with harming or possibly killing others with second-hand smoke? I don't think so.

I see no reason why a non-smoker should have to inhale lung-fulls of my smoke. It is rude and un-civilized. Nearly as bad as the tools who throw their ***** out the car window. My car came equipped with an ashtray...don't theirs?

Is there something wrong w/ your legs that you can't walk outside for 5 minutes?

But to address your question: Many businesses in WA are charging a "membership fee" making it a so-called private club. That is how they get around the smoking ban. And it is usually nominal, like the $1.00 you mentioned.

Doesn't this one burn your ****? I mean really the non-smoking community wants us to smoke and pay extra taxes so that they can enjoy new stadiums, but heaven forbid we smoke in them. Everyone keeps forgetting that this country was founded on tobacco as our first cash crop....and what about just putting the issue in a general election for a vote of the population....I would feel better about a ban if everyone had a say in it...not just the politicians in the state house or white house! I feel as a responsible, voting, tax paying member of society I have a right to smoke....if you don't smoke I will not smoke in your home or your car and will gladly sit in the non-smoking section of the restaurant if we are having dinner together....but when do my rights stop? Why do you feel compelled to inflict your beliefs and habits on me? Maybe if all the non-smokers got together they could figure out what to do with all governmental waste or water pollution or solve the welfare system problems instead of worrying about when I smoke!

Anything anyone can do to wiggle around this ban should do it! Personally I wonder if the Supreme Court would/will uphold such bans.

Back here one bar put a wall between the bar one for smoking and one for not, needless to say there was not enough room in the smoking half.

Its been an ordinance in the Los Angelas area for a long time and seems to be working fine.
I smoke cigars but I dont have a problem with laws that ban public usage. I try not to smoke in front of others anyway. Even I think it is offensive and Id rather not disrespect non smokers.

What they should do is have both smoking bars and non-smoking bars and then everyone wins. But for some reason someone will feel like they are missing something at the other place and then want to have their "personal" rights respected and then we are back where we started.

Me neither, all these health freaks complaining, if they are so concern about it, they should not leave their house because danger is everywhere and in everything.
